Real Estate Litigation Counsel for commercial and residential real estate developer, East GTA.

Job Type: Full-Time Permanent.

Compensation: From $110,000 to $150,000 per annum, according to experience, plus year-end bonus and benefits.

Regular Work Hours: From 9 am to 6 pm, Monday to Friday (40 work hours per week). Additional work hours occasionally required pending volumes of matters.

Work Location: 100% onsite at client's East GTA office, with free parking provided.

Travel Requirements: Occasional local travel to other GTA site locations.

Position Reports To: Head Legal Counsel and CFO.

Responsibilities Summary:

In-House Real Estate Litigation Counsel to enhance and expand capacity of in-house legal team to manage previously outsourced litigation matters, independently handling a portfolio of litigation and pre-litigation files, including new condominium purchaser default files, illegal tenant files, and commercial lease and contract disputes. Will work collaboratively with external corporate investors as well as property management, sales, marketing, accounting and executive teams to support innovative commercial and residential real estate development projects within the GTA, exercising strong advocacy, negotiation, legal research and drafting skills to contribute to all aspects of real estate and development operations.

  • Serve as internal advisor for real estate-related issues, supporting project teams to make legally sound, business-aligned decisions throughout development lifecycle.
  • Manage and oversee litigation and pre-litigation matters involving project disputes, contract enforcement, occupancies, and purchaser claims.
  • Respond to demand letters, draft pleadings, prepare affidavits, and handle negotiations and mediations.
  • Support preparation and review of disclosure statements, purchase agreements, assignment agreements, and relateddocumentation. Provide guidance on Tarion warranty matters.
  • Identify and mitigate legal risks across development projects and corporate activities. Assist with resolution of disputes and claims during turnover, post-registration, or post-construction phases.
  • Represent the company at mediations, arbitrations, tribunal proceedings and court proceedings as required.
  • Additional advisory, dispute resolution andlitigation matters as required.

Qualifications:

Education: JD/LLB from a recognized law school.

Professional Credentials: Member in good standing with the Law Society of Ontario.

Preferred Work Experience: Approximately 3 years of post call experience in commercial and residential real estate litigation.

Preferred Sector Experience: Law firm or legal inhouse experience in dispute resolution (litigation, mediation, arbitration) related to real estate law, condominium law, contracts law or construction law.

Technical and Language Skills Requirements:

  • Proficient with Microsoft Office, Adobe Acrobat, Google Drive, and Ontario Courts Public Portal (OCPP) / Justice Services Online (JSO) Portal.
  • Expert level English communication skills, both written and verbal.

Task -Based Qualifications and Additional Attributes:

  • Ability to independently manage files and meet deadlines in accordance with the Rules of Civil Procedure;
  • Sound knowledge of the Ontario Condominium Act, Ontario New Home Warranties Plan Act, Tarion and HCRA requirements, and construction lien legislation.
  • Experience with residential and commercial real estate transactions and development processes.
  • Demonstrated record of professional conduct and character. Responsible, reliable and works to deadlines.
  • Proven ability to respond to sensitive and confidential matters with tact, discretion, and excellent judgement in the interpretation and application of instructions and organization policy.
  • Demonstrated ability to apply project management principles, methodologies and best practices.
  • Strong relationship management skills including client and vendor relations management, business networking, negotiation and consulting/advisory skills.
  • Demonstratedabilitytoworkwell bothindependently andcollaboratively, and in an advisory capacity,and liaise effectively with a wide and diverse range of internal and externalstakeholders.

Additional Requirements:

  • Must be legally entitled to work in Canada, providing satisfactory documentation upon request.
  • Ability to work 100% onsite, abiding by organization health and safety policies.
  • Ability to declare personal Non-Conflict of Interest in execution of position responsibilities.
  • Interpersonal skills assessment if requested.
