About the Organization

The Mercury Disability Board (MDB) administers a disability benefits scheme established pursuant to the Grassy Narrows and Islington Indian Bands Mercury Pollution Claims Settlement Act, S.C. 1986, arising from the devastating mercury contamination of the English and Wabigoon Rivers in Northwestern Ontario. The MDB oversees a claims and appeals process available to members of Grassy Narrows First Nation and Wabaseemoong Independent Nations, and has recently undergone a modernization process to align its administration and medical assessments with current best practices.

The Opportunity

The MDB is seeking experienced Adjudicators to join its newly reformed Appeal/Review Process. Adjudicators serve on three-member Appeal/Review Panels and hear appeals from MDB claimants who wish to challenge decisions regarding their eligibility for, or the amount of, disability benefits.

This is a contract, roster-based engagement. Hearings may be conducted in person or virtually, with a minimum of 30 days' notice and within 90 days of receipt of the Appeal/Review Request.

Key Responsibilities

• Conduct hearings and receive evidence from claimants, including new medical documentation not previously considered
• Examine and cross-examine witnesses present at the hearing
• Deliberate with fellow Panel members to reach a reasoned decision communicated orally and in writing
• Apply relevant legislation, policy documents, and principles, including the MDB's Guiding Principles and principles of fairness, natural justice, and reconciliation
• Act in good faith and in a manner consistent with the spirit of MDB reform and Indigenous reconciliation

Qualifications

Required:

• Professional experience as a medical professional, or demonstrated knowledge of or experience in healthcare, disability or injury benefits adjudication, or administration
• Experience in a time-sensitive, caseload-driven environment subject to a high degree of scrutiny
• Familiarity with administrative law concepts applicable to statutory decision-making
• Experience interpreting and applying complex legislation and policy
• Strong analytical, writing, and communication skills
• Aptitude for impartial adjudication

Asset:

• Experience working with First Nations communities

Compensation

$200–$350/hour, commensurate with experience.
