On this International Day of Democracy, let us remember that democracy is not a thing we possess or a stage we attain, but a process we engage in. An essential part of this process is the fair, consistent, and transparent application of the law.
Every time a client gets independent, confidential advice from their legal counsel; every time a judge makes a decision without interference or fear of reprisal; and every time someone exercises their freedoms or asserts their rights under our constitution, that’s a manifestation of a healthy democracy.
In Canada, we’re fortunate to have, in general, a legal system characterized by independence and respect for the rule of law. But we’re also acutely aware of how vulnerable the rule of law can be.
It is fitting that, as the world marks this important day, the House of Commons begins its fall sitting in Ottawa. The CBA will be following proceedings with interest, as we continue to advocate for an independent, well-resourced, and effective justice system for all Canadians.
