The CBA Competition Law Section is anticipating another active and exciting year. Here’s what’s going on:

Spring conference

Registration is now open for the CBA Competition Law Spring Conference on developments and decisions in antitrust in Canada and internationally. It will take place May 10, 2018 in Toronto.

CCLR

The Canadian Competition Law Review is a peer-edited review published twice annually by the CBA Competition Law Section.  Access the searchable online format for free.

Volume 30 (Nos. 1 and 2) of the Canadian Competition Law Review is now available online.

The Canadian Competition Law Review is looking for articles on issues in competition law in Canada and around the world. CCLR also accepts comments on noteworthy cases, including consent order settlements. The submission guidelines are available online. Papers can be submitted to cancomplrev@cba.org.

If you would like to submit an article for publication, the deadline for the fall edition is March 9, 2018.

Submissions

The Section has been busy preparing a wide range of submissions.

In November 2017, we commented on the Competition Bureau’s proposal to increase filing fees for merger reviews. While we support an appropriately funded Competition Bureau, we shared some concerns with the fee increase. 

Also in November, we commented on the Competition Bureau’s discussion paper on big data’s implications on competition – where we supported a balanced approach to enforcement when assessing big data’s impact.  

In December 2017, we participated in the CBA working group making submissions on Canada's plan to expand its toolkit to address corporate wrongdoing. We discussed Deferred Prosecution Agreements and enhancements to the Integrity Regime.

We recently made submissions on the proposed changes to the Competition Bureau’s Immunity Program. We shared some concerns that the proposed changes would increase burden on applicants, put Canada’s program out of sync with other jurisdictions and could undermine a crucial enforcement tool. Looking ahead, we will be participating in the upcoming consultation on changes to the Leniency Program.
