A submission on Canada’s Anti-Spam Laws (CASL) Private Right of Action (PRA) provisions has been made to Innovation, Science and Economic Development Canada on behalf of the CCCA, the CBA National Privacy and Access Law Section and the CBA National Competition Law Section. The submission recommends a delay in bringing the PRA Provisions into effect until after the scheduled review of CASL occurs. This delay would give the government an opportunity to assess the appropriateness of the PRA provisions in the context of CASL as a whole, and engage meaningfully with interested parties on their experience with CASL over the last three years.
