Report on the International Law Section’s in-person executive meeting

The CBA International Law Section executive held its annual meeting in Ottawa on May 10 and 11. After meeting with representatives from Global Affairs Canada and the Department of Justice on May 10 – stay tuned for summaries of those productive conversations – the executive met on May 11 to discuss their vision for the Section’s work in the coming year.

Foreign investment in residential real estate: Recognize as FDI or not?

A ubiquitous form of foreign direct investment1 is investment in residential real estate. However, neither trade and investment treaties nor reports on investment reflect this reality. Presumably, investment in housing purchases and construction form part of larger industry categories, e.g. “unspecified” or “business activities,”2 or is obscured due to the elusive nationality of investors,3 consequently escaping classification as greenfield, M&A, or portfolio investment.
