Thank you for being a part of our Section. We have had a very busy few months! Find out what we’ve been up to, from our successful resolution at the AGM to our upcoming events.

AGM RESOLUTION

We are proud to announce that our Section’s resolution was passed at this year’s AGM. Our successful resolution clarifies the CBA’s position on new elder abuse-related offences.

In 2011, the CBA passed Resolution 11-10-A stating its opposition to the addition of a new offence of elder abuse in the Criminal Code. In subsequent years, this resolution has been interpreted to mean that the CBA does not support creating any new offences related to elder abuse. This has hindered our ability to advocate for reform to elder abuse related offences and provide input on proposed legislation and other consultations.

Our successful resolution clarifies that the CBA supports reform and new offences related to elder abuse to address aspects of elder abuse that are currently missing in the Criminal Code, while still not supporting the addition of a specific elder abuse offence. We are looking forward to using our Section’s wealth of knowledge on elder abuse to advocate for a system that better protects vulnerable older adults.

SCAMS AND FRAUDS TARGETING OLDER ADULTS AND THE USE OF EQUITABLE RELIEF – APRIL 16, 2024

This webinar will discuss the latest frauds and scams targeting vulnerable older adults across Canada, such as the grandparent scheme, mortgage lending fraud, and HVAC door to door scams. Police officers will discuss what the criminal law system does about these crimes. The Advocacy Centre for the Elderly will discuss the role lawyers can play in helping older adults who have been targeted. Whaley Estate Litigation Partners will discuss how equitable relief is being applied with increasing frequency, including recent cases in which the court used unconscionability in cases of predatory mortgage lending.

ELDER LAW SECTION ESSAY CONTEST

Our Section’s Essay Contest is currently accepting submissions. The award consists of a monetary prize of $500 and publication of the winner’s paper on the CBA Elder Law Section webpage.

The CBA Elder Law Section has established an essay contest to encourage law students and young lawyers to participate in the activities of the Section and to promote and reward interest in Canadian elder law topics.

The submission deadline for this year’s contest is May 2, 2024. Details on the contest criteria and eligibility are available.

STUDENT OUTREACH EVENTS

We are holding a series of law student outreach events in BC and Ontario. Section members will discuss what elder law is and why we, as elder law practitioners, love this diverse and growing area of law. We will also provide tips for working with older adults and explain the benefits of joining the CBA and our Section.

We have already held our BC session. Kelly Melnyk presented at Thompson River University on February 27.

We will be holding our Ontario student outreach event on Wednesday April 3, 2024 at the OBA Conference Centre. If you know law students in the greater Toronto area, please encourage them to attend to learn more about elder law. Register now!
