Our new co-editors’ inaugural issue of The Canadian Bar Review, Volume 94(1), is now available online.
The issue bridges academia and legal practice by shedding light on matters of importance to legal practitioners. Here is a glance at some of our new content:
- Authors Andrea A. Cole and Michelle Flaherty examine of the source of the right to access to justice and the need to define it within Canada’s constitutional framework so as to better define its content
- Authors Hervé A. Prince and Stéphane Rousseau review the Investment Canada Act (1985) with the goal of determining its level of attractiveness by examining its admission criteria and selection process for foreign direct investment
- Author Catherine PichĂ© analyzes the process that leads to the recovery and distribution of amounts awarded to class action members, in accordance with the relevant sections of Quebec’s new Code of Civil Procedure that came into effect in 2016
- Author Elaine Craig provides an explanation of Canada’s rape shield provisions and of the problems arising with the interpretation and application of section 276 of the Criminal Code. Craig has also written a short piece for CBA National’s blog in which she highlights key aspects of her article, focusing on misinterpretations of s. 276 of the Criminal Code.
Readers will also be happy to know that The Canadian Bar Review has started its transition toward becoming an open-access publication. While it has always been available in the print edition to non-members through a subscription, it will also for the first time in its history be open-access – available online at no cost to all readers.
