Professional Development5.4 Insolvency on the Catwalk: A Look at the Model OrdersTuesday, August 19, 2:30 – 4:00 This panel reviews the evolution, practice and future of the model CCAA/receivership orders. The panel will also look at the evolving role of users’ groups in the fashioning of model order standards in insolvency. The model order process is a practical response of the courts and the professional community to try to keep pace with the evolution of insolvency and restructuring practice, in the absence of timely reform by Parliament or the exercise of active rulemaking authority by the executive branch in the commercial insolvency area. Are political, legislative and executive processes capable of keeping commercial insolvency law and attendant regulatory regimes current? Are there problems with the current informal rulemaking processes by which insolvency model orders are being developed? Are there other alternatives? Speakers: |
