As the number of ways to connect people through social media and other technologies has increased exponentially in recent years, so too have the complexities surrounding hate legislation in the modern era.
What constitutes a hate message? When is it free expression? This CLE will present an overview of hate messages legislation in Canada, both provincially and federally and its interpretation by courts and human rights tribunals.
The presentation will highlight:
- The current debate on interplay between hate messages legislation and freedom of expression.
- The differences between the Criminal Code provisions and the various human rights legislation with respect to hate propaganda.
- Recent developments, such as the recent complaints against publishers for online content, the role of Internet message boards, and the current review of hate messages legislation in some jurisdictions.
