Annual Report – June 2007

Introduction

This is an annual report for the Collaborative Law Subsection. Our last report was January 2007, so this report will very briefly update Collaborative Law activities since then.

Government Meeting – April 12th 2007

On April 12th 2007 the Collaborative Law group was included in a general meeting with CBA and Government. We met with both the Minister of Justice and the Premier.

We took the opportunity to explain the mechanics of Collaborative Law and point out to Government (as well as their Executive staff) the potential CL would have to eliminate or reduce Court traffic and Court waiting times.

A follow-up memo was sent to appropriate levels of Government afterwards summarizing the presentation.

The message to Government was that the Court workload and the present pressures on the Justice system in general, could be considerably reduced through a systematic application of non-Court alternatives – including Collaborative Law where appropriate.

Challenges to Collaborative Law

The challenges to Collaborative Law remain the same. There needs to be continued effort expended in order to get the message out to (1) Lawyers; and (2) the Public. Our Committee will continue to explore ways to achieve this over the next 12 months.

Recently one of our members (Flanagan) had incorporated Collaborative Law into a CLE presentation in Moncton on Estate Planning with respect to ‘extended’ (i.e. multi-spouse) families.
