CBA-NB says immunity provisions contained in Bill 44 should be removed

CBA-NB calls on government to provide administrative funding for family court judges

The Canadian Bar Association-New Brunswick is calling on the Minister of Justice to confirm that the Government of New Brunswick will not delay the appointment of new Family Court Judges and will provide the required funding for their administrative support.

In a letter sent today to the Minister (full text below), Jade Spalding, President of CBA-N.B. says the number of cases filed in the Family Court across New Brunswick has increased by an average of 45% in the past 10 years, with no increase in the number of judges. "This has resulted in significant delays in the Family Court system," says Jade Spalding.

Long waits lead to real suffering and have "added to the problems faced by parents and children struggling with the already stressful situation of family break-down."

Judicial Appointments to Family Division March 19, 2008

Thank you for discussing this matter with me on the telephone today. As you know, the Family Court System in New Brunswick is over burdened with cases to handle. Over the last ten years the number of cases filed in the Family Court across New Brunswick has increased by an average of forty-five percent, while the number of Judges has remained the same. This has resulted in significant delays in the Family Court System. Spouses, parents and children are now forced to endure long waits before serious issues such as child custody, financial support, and divorce can be dealt with. This is leading to real suffering and has added to the problems faced by parents and children struggling with the already stressful situation of family break-down.

The Federal Government has indicated its intention to appoint three new Family Court Judges in New Brunswick to deal with this problem. There appears to be uncertainty regarding the willingness of the New Brunswick Government to fund the administrative support requirements for these new Judges. In light of this, we would ask you to confirm that the Provincial Government will not delay the appointment of the new Family Court Judges and will provide the required funding for their administrative support.
