The Class
1. The Plaintiffs bring this action on their behalf and on behalf of all others similarly affected as members of the proposed Class, hereinafter collectively referred to as the “Plaintiffs”, “Class Members” or the “Class”, which words are intended hereafter to include all of the following individuals, defined as follows:
(a) Class Members
Any person in Canada, or their estate, who was prescribed and purchased or used Fentanyl manufactured by the Defendants between December 20, 1991 to the date of certification.
(b) Deceased Relatives
The Plaintiffs are representative of a Class of persons in Canada, which include, but is not limited to, spouses, adult interdependent partners, children, parents, sisters and brothers who have died after using Fentanyl, hereinafter collectively referred to as “Relatives”.
