Wayne Westcott v. Norvatis Pharmaceuticals Canada Inc., Norvatis Consumer Health Canada Inc., Norvatis Pharma Services AG., and Norvatis Pharma AG.

THE CLASS

1. The Plaintiff brings this action on his behalf and on behalf of all others similarly affected as members of the proposed Class, hereinafter collectively referred to as the “Class Members” or the “Class” are intended to include the above mentioned individuals, defined as follows:

SASKATCHEWAN CLASS MEMBERS

2. Persons resident or situated in Saskatchewan, more particularly described as follows:

a) All persons in Saskatchewan, who are taking or have taken Prexige, suffered, will suffer or are at risk of suffering from one or more of the medical problems or personal injuries, including but not limited to liver damage and kidney dysfunction between Novembr 2, 2006 and October 3, 2007.

NON RESIDENT CLASS MEMBERS

3. Persons not resident or situated in the Province of Saskatchewan, however, resident or situated in another Canadian provinces or territories, more particularly described as follows:

a) All persons outside of Saskatchewan but inside of Canada, who are taking or have taken Prexige, suffered, will suffer or are at risk of suffering from one or more of the medical problems or personal injuries, including but not limited to liver damage and kidney dysfunction between November 2, 2006 and October 3, 2007.
