All physical persons in Quebec and Canada and all legal persons in Quebec and Canada who, during the twelve (12) month period preceding this Motion for Authorization to Institute a Class Action, had not more than fifty (50) employees under their direction or control, who have communicated to the Respondents personal information or confidential credit card or debit card information that was subsequently lost to or stolen by persons unknown from the computer databases or other records of the Respondents.
