All persons (including their estates, executors, or personal representatives) corporations and other entities who purchased digital cable/Rogers on Demand service from the Defendants; and All persons (including their estates, executors, or personal representatives) corporations and other entities who rented a digital cable box from Rogers; and All persons (including their estates, executors, or personal representatives) corporations and other entities who were under contract for the digital cable/Rogers on Demand service between June 2006 and September 2006; and All persons (including their estates, executors, or personal representatives corporations and other entities who experienced an interruption in their digital cable/Rogers on Demand service of approximately four months; and All persons (including their estates, executors, or personal representatives) corporations and other entities who continued to pay the full monthly amount for their digital cable/Rogers on Demand service during the period in which they were not receiving this service; andAll persons (including their estates, executors, or personal representatives) corporations and other entities who were not notified of, offered or given compensation or credit from Rogers and/or Cable, Telecom, and Media for the aforementioned break in their digital cable/ Rogers on Demand service. The Plaintiff also makes this claim, on their own behalf and on behalf of all members of a Non-Resident subclass of persons, corporations, and entities not resident or situated in the Province of Ontario, however are resident or situated in another Canadian province or territory. |
