Federal Court Orders Richmond Hill Business Khaike Paan and its Proprietors be Added as Named Defendants in Vinod Chopra Copyright Infringement Action
Vinod Chopra Films Private Limited, et al. v. John Doe, et al., 2010 FC 269 (Hughes, J.)

March 9, 2010

Georgina Starkman Danzig for the Plaintiffs, Vinod Chopra Films Private Limited, et al.
No one appearing for the Defendants, John Doe, et al.

The Plaintiffs brought a motion for review of an Anton Piller Order granted by the Court in order to add Murad Mauji (or Mavji) otherwise known as Yeh Khaike Paan Meri Haan and Manur Samji as named defendants in the action. Rahim Mauji (or Mavji) represented himself and spoke on his behalf and on behalf of his father Murad Mauji.

On or about February 10, 2010 a private investigator acting for the Plaintiffs purchased a DVD at a store named Khaike Paan upon which was copied the motion picture at issue, “3 IDIOTS”. The following day when the proprietors of Khaike Paan were served with the relevant documents, no copies of the DVD recordings of “3 IDIOTS” were located but an empty cassette with artwork depicting the motion picture was located on the premises. On the evidence before it, the Court was satisfied that Rahim Mauji and Murad Mauji were responsible for Khaike Paan and ordered that all three parties be added as named defendants to the action.
